Terms of Use

Article 1 - Purpose

These Terms of Use (ToU) aim to define the terms and conditions of use of the Giroud Agency platform, accessible at giroud-agency.ch, as well as the rights and obligations of users.

Article 2 - Definitions

• Platform: the website giroud-agency.ch and all its associated services
• User: any person who accesses the Platform
• Client: any User who has subscribed to a paid service
• Service: all services offered by Giroud Agency
• Client website: the website created and hosted for the Client

Article 3 - Access to the Platform

The Platform is freely accessible to any User with Internet access. All costs related to accessing the Platform (hardware, software, Internet connection, etc.) are the responsibility of the User.

Giroud Agency uses all reasonable means to ensure continuous access to the Platform but cannot guarantee 100% availability. The Platform may be temporarily unavailable for maintenance, updates, or other technical reasons.

Article 4 - Registration

Access to certain services requires prior registration. The User agrees to provide accurate and up-to-date information during registration.

Each User may only create one account. Creating multiple accounts may result in the suspension or deletion of all affected accounts.

The User is responsible for the confidentiality of their login credentials and all activities performed from their account.

Article 5 - User Account

The User can modify their personal information at any time from their client area.

The User can request the deletion of their account. This deletion will result in the loss of all data associated with the account, including created websites, after the end of the current subscription period.

Article 6 - User Obligations

The User agrees to:

• Use the Platform in accordance with its purpose and these ToU
• Not interfere with the operation of the Platform
• Not attempt to access unauthorized areas of the Platform
• Respect the intellectual property rights of Giroud Agency and third parties
• Not use the Platform for illegal or unauthorized purposes

Article 7 - Prohibited Content

It is strictly prohibited to publish on websites created via the Platform any content that is:

• Illegal, defamatory, insulting, obscene, or pornographic
• Inciting hatred, violence, or discrimination
• Infringing on the intellectual property rights of third parties
• Containing viruses or other malicious code
• Violating the privacy of others

Article 8 - Intellectual Property

The Platform and all its elements (design, code, texts, images, logos, etc.) are the exclusive property of Giroud Agency and are protected by intellectual property laws.

The Client retains intellectual property of the content they publish on their website (texts, images, etc.). They grant Giroud Agency a non-exclusive license to host and display this content as part of the Service.

Article 9 - Liability

Giroud Agency cannot be held liable for direct or indirect damages resulting from the use or inability to use the Platform.

The User is solely responsible for the content they publish on their website and indemnifies Giroud Agency against any third-party claims in this regard.

Article 10 - Modification of ToU

Giroud Agency reserves the right to modify these ToU at any time. Changes take effect upon publication on the Platform. Continued use of the Platform after modification constitutes acceptance of the new ToU.

Article 11 - Applicable Law and Jurisdiction

These ToU are governed by Swiss law. Any dispute relating to the interpretation or execution of these ToU shall be subject to the exclusive jurisdiction of the courts of the Canton of Valais, Switzerland.
